The prosecutor's appeal is dismissed.

1. The sentence of the court below (one year of suspended sentence in six months of imprisonment) is too unhued and unfair.

In light of the following factors: (a) the degree of damage to the victim was serious; (b) the defendant was committed for the same kind of offense; (c) there were many criminal records of the defendant; and (d) the defendant did not reach an agreement with the victim; (b) the defendant recognized his mistake and reflects his health; (c) the defendant's health status is very poor; (d) the defendant is not in economic situation as a basic livelihood recipient; and (e) other factors of sentencing as indicated in the records, such as the motive and background leading up to the crime of this case; (e) the defendant's motive and background leading up to the crime of this case; (e) the defendant's age, character, conduct

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
