1. The defendant,
A. The amount of KRW 520,000,000 to Plaintiff A and the annual amount of KRW 6% from August 13, 2013 to August 20, 2014; and
Reasons
1. Basic facts
A. The defendant is a legal entity that operates a “Blubert-based golf club” (hereinafter “instant golf club”), which is a deposit member golf club at the 156-1st unit in Gwangju City-si 156-1, and the plaintiffs are those who have acquired the membership of the instant golf club.
B. The Defendant’s establishment process 1) Tourist Development Co., Ltd. (hereinafter “Saeong Tourism”).
(1) On September 28, 1989, the Plaintiff established the instant golf course facilities in the size of 18 holes with the approval of the project plan for the construction of a membership golf course in the size of 18 holes from the Gyeonggi-do Governor, and on December 24, 1994, the Installation and Utilization of Sports Facilities Act (hereinafter “the Installation and Utilization of Sports Facilities Act”).
(2) On November 197, 1997, the Gyeonggi-do Governor registered the instant golf course business under the name of the Gyeonggi-do Governor on the condition that he/she concurrently sets up the instant golf course of nine holes, and opened the instant golf course business by recruiting its members. (2) After which tourism on board the instant golf course was defaulted on November 27, 1997, the auction procedure was initiated on the premises of 18 holess of membership golf courses and the buildings of the instant golf course (hereinafter “the instant golf course site, etc.”) among the entire site of the instant golf course.
Of the members on board tourism, 564 members contributed to 58 million won per person for the purpose of purchasing a site for 18 holes of the instant golf course, and subsequently, Ora Tourism Development Co., Ltd. (hereinafter referred to as “Mol Tourism”) was established, and Oradong Tourism purchased the instant golf course site, etc. at the above auction procedure, and paid in full the auction price on August 13, 2001, and completed the registration of transfer of ownership under the name, and thereafter transferred the instant golf course on March 25, 2002, and operated the instant golf course under the name of the said sports conference from April 202 to April 2002.
