A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

나. 상해, 폭력행위등처벌에관한법률위반(집단ㆍ흉기등협박) 피고인은 위 가항 기재 일시, 장소에서 피해자의 허락을 받지 않고 집에 들어왔다는 이유로 피해자가 자신에게 물을 뿌리자 피해자에게 ‘이 년아, 늙은 년아 너 같은 년은 콱 죽여 분다’라고 욕을 하면서 손으로 피해자의 멱살을 잡아 주먹으로 피해자의 얼굴을 수회 때리고, 발로 피해자의 무릎 등을 수회 걷어차며, 계속하여 피해자의 집 창고에 있는 위험한 물건인 곡괭이(자루길이 약 37cm, 날 길이 약 26cm)를 손에 들고 피해자에게 ‘자식도 가족도 없는 너 같은 년, 죽여 버려도 아무도 모른다, 너 죽이고 나도 교도소 가면 된다, 이 늙은 년아’라고 욕을 하면서 곡괭이로 피해자를 때릴 듯이 위협하였다.
