1. The plaintiff's claim is dismissed.

According to the purport of Gap evidence No. 1, including the conclusion of a business agreement, and the entire pleadings, the plaintiff and the defendant entered into a business agreement on September 2, 2014 with the content that the defendant shall pay a business fee if the plaintiff had a sexual intercourse with the supply contract to promote the sale of products such as rice and yeast water produced by the defendant (hereinafter "the agreement of this case"), and the main contents thereof can be acknowledged as follows.

Article 2 (Obligation of Defendant) The Defendant shall pay 3% of the total sales to the Plaintiff on the day on which the Plaintiff received the payment for the sale, which the Plaintiff had entered into a contract on behalf of the Defendant.

Article 3 (Obligation of the Plaintiff) The Plaintiff shall issue a tax invoice equivalent to the sales commission to the Defendant and provide it to the Defendant.

Article 4 (Obligation of Defendant, Plaintiff, etc.) Business Entities shall prevent the same company from being promoted under an agreement after prior notification.

The plaintiff's primary business is GS re-tail, CUart, Lotte Mart, Hemepus, GSart, agricultural cooperatives, the Ministry of National Defense and its affiliated organizations.

Article 5 (Business Scope of B) Restrictions on the domestic market

Article 6 (Period of Agreement) It shall be from the date of contract to the time the sales contract is maintained, and shall be continued unless both parties express their intention of termination.

A. After entering into the instant agreement, the Plaintiff’s gist of the assertion was to conduct a concentrated business activity for the Nonghyup, the Armed Forces Welfare Group, and the GS retail.

In other words, the plaintiff requested cooperation from the National Agricultural Federation Chairperson, visited the National Agricultural Cooperative Federation Federation several times to contact with its executives and employees, requested cooperation from the head of the National Defense Welfare Center, made efforts for the sales of the defendant's products to meet the working-level manager, requested cooperation from the head of the headquarters B of the ZE, contacted the head of the working-level team, and operated the business.

As a result, the defendant will deliver the defendant's products to the above three enterprises.
