그러나 사실 피고인은 피해자로부터 돈을 받더라도 영주 미륵불에 금을 입히는 명목으로 돈을 사용할 의사가 없었고, 피해자의 자식에 대한 위해를 해소할 의사나 능력도 없으며, 단지 피해자에게 불안감을 조성하여 피해자로부터 돈을 편취하려한 것이었다.
