Reasons
1. Basic facts
A. On December 10, 2003, 2008, the golf membership trade between the Gangseo-gu Sports World Co., Ltd. (hereinafter “Geuri Sports World”) and the Tronon golf club (hereinafter “Trovia”) was acquired at KRW 660 million by the Defendant’s “two-party designated golf club membership” of the “two-party designated golf club.” The Defendant issued two membership certificates (B and C) and entered in the membership management ledger (hereinafter “instant membership membership number B”), and the two membership cards collectively referred to as “instant membership, etc.”).
2) On April 2, 2007, the Gangnam Sports World established a pledge right (hereinafter “instant pledge right”) equivalent to the maximum debt amount of 8.8 billion won with respect to the instant membership rights against Down Mutual Savings Bank (hereinafter “Down Mutual Savings Bank”) on April 2, 2007, and upon receipt of the Defendant’s notification of the said pledge to the Defendant, the Defendant accepted the fixed date copy of the said pledge right on the same day.
3) On September 17, 2007, the Gangnam Sports World sold the instant membership, etc. to Twits KRW 1.160 million. around that time, “Around that time, a member’s certificate was lost and submitted to be held liable for civil and criminal liability for damage from the loss and damage from the loss” was applied for the transfer and acquisition of the instant membership, etc., along with Twits along with the announcement of loss and the publication of loss in newspapers.
