A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant, as a person with bad credit standing, did not have any other income or property than KRW 700,000,000 from monthly income through self-support labor, and was under circumstances where he/she bears approximately KRW 400,000,000 from others.

Nevertheless, on February 8, 2010, the Defendant made a false statement to the effect that “The Defendant would have repaid the money to the victim D,” from the mutual influences located in the Kugdong-gu, Busan.

The Defendant, around the 10th day of the same month, received from the victim the total amount of KRW 53,50,000,000 from the time of receiving KRW 10,000,00 from the corner of the National Bank of Korea, which was located at the same 223-83, e.g., the Defendant, by deceiving the victim as indicated in the attached crime list from August 201.

2.
