1. The Defendant (Counterclaim Plaintiff) paid KRW 394,60,000 to the Plaintiff (Counterclaim Defendant) and the Plaintiff’s payment from May 3, 2017 to September 5, 2019.

1. Facts recognized;

A. The Plaintiff is a stock company established for the purpose of manufacturing agricultural machinery, etc., and the Defendant is an agricultural company with the main purpose of processing and selling agricultural products.

B. On September 6, 2016, the Plaintiff sold red ginseng tank facilities (hereinafter “instant red ginseng tank”) to KRW 247,500,000 (including value-added tax; hereinafter the same shall apply) with the Defendant. The place of supply of the instant red ginseng tank is the place designated by the Defendant, and the said price was to be paid in cash within seven days after delivery and trial operation (hereinafter “first contract”).

C. On September 27, 2016, the Plaintiff and the Defendant sold the Gomamaman 1 type (hereinafter “the instant processing licensee”) for KRW 745.8 billion. The supply place of the instant processing licensee is the place designated by the Defendant, and the intermediate payment of KRW 22.374 million is within seven days from the contract date, and the intermediate payment of KRW 29,8320,000,000 is within seven days from the contract date, and the remainder of KRW 22,374,00,000,000,000 for each payment within seven days from the contract date (hereinafter “instant contract”).

After the conclusion of the contract Nos. 1 and 2, the Plaintiff installed the instant red ginseng tank and the instant processingra in the Defendant factory, which is the place at which the Defendant requested, and carried out the tallying and trial operation.

The Plaintiff received a request from the Defendant to change the red ginseng-saving tank in the course of tallying and trial operation and sent a quotation of KRW 1,485,00,000 to the Defendant on December 2016. On February 2, 2017, upon receipt of a request to replace a bridge, the Plaintiff sent a quotation of KRW 25,30,000 to the Defendant. On February 2, 2017, upon receipt of a request to install an additional red ginseng tank equipment, the Plaintiff sent a quotation of KRW 64,90,00 to the Defendant.

hereinafter the above red ginseng tank change costs, the replacement costs of the school base tank, and the additional installation costs of the red ginseng tank equipment are combined, and "the additional goods costs of this case" are added.
