A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On December 3, 2010, the Defendant: (a) obtained a loan of KRW 700 million from the Victim Small and Medium Business Corporation located in Jinju-si; and (b) established a collateral security at KRW 840 million with respect to the said real estate as collateral for the said debt; (c) on February 22, 2011, with respect to the collateral security established as above, the Defendant created a change into a factory and a collateral security under the Mining Foundation Mortgage Act by providing all 17-type machinery equipment, a factory machine, as additional security, as well as 17-type type, with regard to the collateral security established around February 22, 2011. As such, the Defendant was the Defendant, who was a debt manager prior to the repayment of the above loan, and was required to manage the said comprehensive collateral security property as a collateral for the person who created the collateral security interest.
