A defendant shall be punished by imprisonment for not less than one year and six months.
Seized evidence1 through 6 shall be confiscated, respectively.
Reasons
Punishment of the crime
The Defendant, in collusion with the organization of the crime of Bosing in China and with the name and non-ffort (C) of the organization of the crime of Bosing in China (C) and the name and non-ffort boxes (C), committed the crime with the intent to use it in the crime, received cash withdrawal cards from the name of the said criminal organization, and withdrawn the money deposited by the victims of Bosing in parks, etc., and used them to acquire the amount of KRW 100,000 to KRW 150,000 per day in return for remitting it to the above criminal organization.
1. No person who violates the Electronic Financial Transactions Act shall keep, deliver or distribute a means of access for electronic financial transactions with intent to use it for a crime or knowing that it is to be used for such crime;
가. 2016. 10. 18.경 범행 그럼에도 불구하고 피고인은 2016. 10. 18. 21:00경 위 성명불상자로부터 위챗 메시지를 통해 지시를 받아 인천 남동구 예술로 149 인천종합문화예술회관 공원 내 벤치에 찾아가, 위 범죄조직이 ‘취업을 하는데 필요하다’고 하여 D으로부터 건네받아 퀵서비스 등을 통해 그곳에 미리 배달해 놓은, 전자금융거래를 위한 접근매체인 위 D 명의의 신한은행 계좌(E)에 연결된 현금인출카드(F) 1장을 범죄에 이용할 목적으로 전달받아 보관하였다.
나. 2016.10. 19.경 범행 그럼에도 불구하고 피고인은 2016. 10. 19. 19:30경 위 성명불상자로부터 위챗 메시지를 통해 지시를 받아 인천 남동구 예술로 149 인천종합문화예술회관 공원 내 벤치에 찾아가, 위 범죄조직이 ‘취업을 하는데 필요하다’고 하여 G로부터 건네받아 퀵서비스 등을 통해 그곳에 미리 배달해 놓은, 전자금융거래를 위한 접근매체인 위 G 명의의 우리은행 계좌(H)에 연결된 현금인출카드(I) 1장을 범죄에 이용할 목적으로 전달받아 보관하였다.
