All appeals are dismissed.

The grounds of appeal are examined.

1. Examining the reasoning of the lower judgment as to the Defendant’s grounds of appeal in light of the evidence duly admitted, the lower court is justifiable to have found the Defendant guilty of all the charges of this case (excluding the amended part of the indictment) on the grounds stated

In so doing, contrary to what is alleged in the grounds of appeal, there were no errors by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the legal doctrine on the intentional act of violating the Housing Act, Information and Communications Network Utilization Promotion

In addition, the argument that the court below erred in the misapprehension of legal principles as to the grounds for the dismissal of illegality under Article 310 of the Criminal Act is not a legitimate ground for appeal, as it is alleged in the ground of appeal that the defendant did not consider it as grounds for appeal or ex officio

2. As to the prosecutor’s grounds of appeal, the lower court determined that the modified facts charged in the instant case were not proven, on the grounds as indicated in its reasoning.

The judgment below

In light of the records, the above determination by the court below is just, and contrary to the allegations in the grounds of appeal, there were no errors by misapprehending the legal principles on the crime of violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection

3. Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
