A defendant shall be punished by imprisonment for five years.

Punishment of the crime

2. 피고인은 2011. 4. 말 05:00경 위 교회 성전 뒷방에서 제1항 기재와 같이 잠을 자고 있는 피해자(당시 11세)를 보고 다가가서 피해자의 옷과 브래지어를 위로 올린 다음 혀로 피해자의 한쪽 가슴을 약 5분 정도 핥음으로써 피해자의 항거불능 상태를 이용하여 13세 미만의 사람인 피해자를 추행하였다.
