Defendant shall be punished by a fine of KRW 10 million.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) was engaged in driving of B Beetle 2.0 TDI cars.
On January 31, 2020, the Defendant driven the said car while under the influence of alcohol 0.151% of the blood alcohol concentration around 23:16, and led to a two-lane road in front of Seocho-gu Seoul to drive the said car along the one-lane.
Since the place is where the center line of yellow solid lines is installed, a person engaged in driving service has a duty of care to thoroughly operate the front line and safely drive the car line.
Nevertheless, under the influence of alcohol, the Defendant was negligent in driving along the center line by the negligence of neglecting it, and was driven by the victim D(59 years of age) who proceeded in the opposite part, and was driven by the victim D(59 years of age) on the left side of the taxi vehicle by the Defendant.
Ultimately, the Defendant driven a motor vehicle in a situation where normal driving is difficult due to the influence of drinking, and suffered injury, such as “influoral salt, tension, etc.,” which requires two weeks’ medical treatment, to the victim.
2. On April 14, 2015, the Defendant has been issued a summary order of a fine of four million won at the Seoul Central District Court for the crime of violating the Road Traffic Act.
The Defendant driven the said car under the influence of alcohol concentration of 0.151% at the section of approximately 1.6 Km from the distribution to the front of the exit 6-2, Seocho-gu, 33-gil 6-2, the new distribution route, from the location near the Seoul New Station in Gangnam-gu, Seoul, at the same time as paragraph (1).
