1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The Plaintiff is the owner of each piece of land with a lot of 293m2 and a parking lot of 454m2 and a lot of 454m2 (hereinafter “instant site”).

B. On July 28, 2017, the Plaintiff filed an application for joint deliberation on a construction plan with respect to the construction of a neighborhood living facility and an urban residential housing (126 households) with a size of 4 stories below ground, 15 stories above ground, total floor area of 9,033.7 square meters on the instant site to the Defendant.

C. On August 7, 2017 and August 21, 2017, the Defendant issued a supplementary notice to the Plaintiff regarding the application for deliberation. Accordingly, the Plaintiff prepared supplementary documents and submitted them to the Defendant.

On September 19, 2017, the Joint Committee (hereinafter referred to as the “Committee”) to which the Defendant belongs (hereinafter referred to as the “Committee”) held a deliberation and rejected the deliberation for the following reasons. On September 25, 2017, the Defendant notified the Plaintiff of the results of the deliberation.
