피고인은 2013. 6. 26. 안양시 만안구 C, 비(B)01호(D) 자신의 집에서, 컴퓨터를 이용하여 인터넷 온라인 게임 ‘E’를 하는 사람들의 커뮤니티 공간 사이트인 ‘E’ 갤러리에 닉네임 ‘F’으로 접속하여 피해자 G이 인터넷 네이버 카페 ‘H’에서 사용하는 닉네임 ‘I’에 대하여, “게시글과 덧글은 I이 다묵어부렀어”, “I의 E 왕국”, “팔은 안으로 굽는다죠”, 2013. 10. 13.경 “J 새끼한테 I 개새끼라고 해보라고 하였다”, “I반자이 돌격대, I 개새끼 해봐”, 2013. 10. 14.경 “I 저 병신 같은 성격이며 취업해도 만년 인턴일 듯”, “존나 졸보같은 성격인데 상사가 지랄하면 못 견디고”, “나 E 명문 클랜 J 클장이고 네이버 E 대표카페 매니저라고요! 라고 할 새끼임 분명 ㄹㅇ”, “존나 쫄보새끼네 I 이러니까 취업이 안되지 ㅉㅉ”라는 글을 게재하여 공연히 피해자를 모욕하였다.
