AM shall be punished by a fine of seven million won, by a fine of three million won, and by a fine of four million won.

Punishment of the crime

No person shall issue a transaction instruction in electronic financial transactions or transfer or take over any access medium used to secure the authenticity and accuracy of users and the details of such transaction, or lend or borrow any access medium while receiving, demanding or promising to receive compensation therefor.

1. On December 2016, Defendant AM issued five physical cards connected to the account of the Defendant (BA), Korea bank account (BB, BC, BD), and the National Bank (BE) account and lent the access media for consideration to the Defendant. Defendant AM issued five copies of the physical card to the Defendant (BA), and received the payment for the use for the use for the use of the card.

2. 피고인 AP 피고인은 2017. 1. 초순경 서울시 강동구 길동에 있는 상호 불상 커피솝에서, I으로부터 체크카드를 빌려 주면 매월 체크카드 1매 당 30만 원을 받기로 하고, I에게 피고인 명의 국민은행 계좌 (BF), 신한 은행 계좌 (BG, BH) 와 각 연계된 체크카드 3매를 교부하여 대가를 약속하면서 접근 매체를 대여하였다.

On March 1, 2017, the Defendant: (a) at “BJ restaurant” located in Gangdong-gu Seoul Metropolitan Government BI; (b) at the “BJ restaurant”; (c) at the time of lending the e-mail card from I, the Defendant borrowed the e-mail card at KRW 300,000 per month; and (d) at the Defendant’s corporate bank account (BK) and the new bank account (BL), the Defendant offered the e-mail card and lent the e-mail for consideration.
