1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. D Co., Ltd. (hereinafter “D”) completed the registration of the establishment of a new mortgage on the instant real estate by the Seoul Northern District Court’s Dobong-gu Office No. 53200, Sept. 4, 2009. 2) D completed the registration of establishment of a new mortgage on the instant real estate as No. 63506, Jul. 13, 2005, the maximum debt amount of which was KRW 20,800,000, and the debtor F.
3) On December 4, 2009, D changed the debtor to E and completed the registration of change of the right to collateral security (hereinafter “instant right to collateral security”) by changing the debtor to E and completing the registration of change of the right to collateral security (hereinafter “instant right to collateral security”).
(B) On November 17, 2010, the Plaintiff and the Plaintiff purchased the instant real estate at KRW 36 million and paid KRW 5 million as down payment, and entered into a sales promise with the date of the completion of the purchase and sale promise as of December 31, 201. As to the instant real estate, the Plaintiff completed the registration of the right to claim transfer of ownership on the ground of the purchase and sale promise as of November 18, 201, Seoul Northern District Court Dobong District Court No. 6931, Nov. 18, 2010 (hereinafter “instant provisional registration”).
(C) On November 30, 2011, the Gangnam-gu Seoul Metropolitan Government Office (hereinafter “Gangbuk-gu Office”) seized the instant real estate on the grounds of default of KRW 1,203,100 of the E’s property tax, and completed the attachment registration as the Seoul Northern District Court’s Dobong-gu Office received on January 16, 2012.
The Korea Asset Management Corporation was delegated on June 18, 2012 by the Gangwon-gu Office to sell the real estate in this case.
(2) On October 10, 2012, the Korea Asset Management Corporation issued a public auction notification with the estimated sale price of KRW 75 million on November 26, 2012, the date of the completion date of the request for distribution, and the period from December 10, 2012 to December 12, 2012. As to the instant real estate, the Seoul Northern District Court’s Dobong registry office received on October 10, 2012, and the public auction notification was registered as of October 10, 2012 as of December 7, 2012.
