1. 피고인 A, B의 공동범행 피고인 A은 2013. 6. 25. 22:50경 광주 북구 일곡동에 있는 G편의점 일곡제일점 앞길에서, 여자친구인 H와 말다툼을 하던 중 피해자 C(31세), D(34세)이 자신들을 쳐다보며 욕설을 한 것으로 오해하고 그들에게 다가가 "뭘 쳐다보냐"고 시비하면서 피해자 C의 멱살을 잡고 주먹으로 얼굴을 때리고 계속하여 손으로 피해자 C의 오른쪽 약지손가락을 잡고 꺾어버리고, 피고인 B은 이에 가세하여 주먹으로 피해자 D의 얼굴을 때려 그 곳에 있는 바닥으로 넘어뜨린 후 발로 그의 다리를 밟아 피해자 C에게 4주간의 치료를 요하는 우측 4번째 손가락 골마디 뼈의 골절상, 우측 둔부 부위 염좌 및 긴장상, 안면부 타박상을, 피해자 D에게 2주간의 치료를 요하는 상세불명의 목 부분의 열린 상처, 기타 및 상세불명의 목 부분의 관절 및 인대의 염좌 및 긴장상, 무릎의 타박상을 각 가하였다.
