Reasons
Punishment of the crime
[Criminal Justice] On January 11, 2018, the Defendant was sentenced to imprisonment with prison labor for one year and six months at the Suwon District Court for the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, and completed the execution of the sentence on April 7, 2019. On September 22, 2016, the Defendant was sentenced to one year of imprisonment with prison labor at night in the Daejeon District Court’s Incheon District Court’s Support for the Aggravated Punishment, etc. of Specific Crimes, and completed the execution of the sentence at a public prison on July 21, 2017. On May 14, 2014, the Defendant was sentenced to two years of imprisonment with prison labor for the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, etc., and was sentenced to two years of imprisonment with prison labor for night intrusion and larceny at the Seoul District Court’s night on February 15, 2013. On January 28, 2010, Daejeon District Court was sentenced to imprisonment with prison labor for one year and two months.
【Criminal Facts】
On June 2, 2019, around 01:50 on June 2, 2019, the Defendant: (a) entered the Dongnam-gu Seoul Metropolitan City Cel with a view to stealing the property from Dho Lake; (b) applied the inside cresh in which the victim E was locked, but did not find stolen objects; and (c) failed to do so.
As well as this, the Defendant from the first step of April 2019 to the same year.
6.2. From around 01:50 to around 01:50, a total sum of KRW 2,539,000 was stolen or attempted to steals, as stated in the list of offenses.
Accordingly, even though the defendant was sentenced to imprisonment not less than three times due to larceny, the defendant attempted to steal or steal the victims' property during the repeated crime period.
