A defendant shall be punished by imprisonment for six months.

Punishment of the crime

The defendant shall serve as a general administrative support worker belonging to the Geumcheon-gu Seoul Metropolitan Government C Community Service Center located in Geumcheon-gu, Geumcheon-gu, from April 25, 2014, and he/she shall not desert away from his/her service or serve in the relevant field for at least eight days in total without justifiable grounds.

Nevertheless, the Defendant, on June 30, 2014 (one day), August 28, 2014 (one day), September 3, 2014 through September 4, 2014 (2), November 7, 2014 (2) from November 6, 2014 to November 7, 2014; and (1) November 10, 2014; and (3) from March 23, 2015 to April 8, 2015 (excluding weekends) without justifiable grounds.

The grounds for sentencing under Article 89-2 subparag. 1 of the relevant Act on Criminal Crimes are as follows: (a) even though the Seoul Northern District Court has served on September 2, 201, the Defendant was sentenced to a suspended sentence of five years for a violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (special rape) at the Seoul Northern District Court, it is inevitable to sentence the Defendant to commit the instant crime during the suspended sentence period.

However, the defendant's confession of the crime of this case and all the conditions of sentencing shown in the records and arguments of this case, including the defendant's age, character and conduct, environment, circumstances after the crime, etc., shall be determined as ordered by considering the following factors.
