A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, while working as parking managers in the Daegu Suwon-gu paid parking lot for B building, purchased tax-free tobacco imported domestically from among domestic tobacco for export to Korea only at low prices in military units or bonded areas, etc., and sold them at low prices, etc. at Busan-gu Busan-gu Busan-ro market, etc., and sold 2,000-3,000 to customers using the parking lot, etc., with the margin of KRW 2,00 per minute.

Where it is intended to export, import or return goods in violation of the Customs Duties Act, the name, standard, quantity and price of the relevant goods and other matters prescribed by Presidential Decree shall be reported to the head of a customs office and no goods imported shall be acquired, transferred, transported, stored, arranged or appraised without filing a declaration;

Accordingly, the Defendant acquired and transferred tobacco 182 smoke, which was imported without reporting.
