1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. The Plaintiff, as the representative of the Child Care Center B, a private nursery in Daegu-gu, (hereinafter “Child Care Center”), is operating the Child Care Center.

B. On May 15, 2015, the Defendant conducted a guidance and inspection of the childcare center on the instant childcare center, and confirmed the following violations, and issued a corrective order as follows to the Plaintiff on July 17, 2015 (hereinafter “instant disposition”).

- Insufficient account books, etc. that are the basis for the disposition of the order to correct the violation - incomplete account books, etc. - Nos. 4 of the Infant Care Act - Nos. 44 of the Infant Care Act - The E, F, A’s corrective order - the keeping of personnel record cards - the disbursement of 368,000 won for teaching materials and teaching materials on March 2, 2015 without evidentiary documents of Article 44 subparag. 4 of the Infant Care Act, 30,000 won for signboards maintenance, 50,000 won for vehicles on March 10, 2015 - the disbursement order - the monthly payment under Article 44 subparag. 4 of the Infant Care Act (tax invoices, credit card settlement, Cash Receipt, etc.) - the order to improve the number of years paid (62,060 won) for buildings or the monthly payment (62,060 won for child care center operation expenses) - the purport of the appeal No. 1 to 4 of the whole evidence

2. Whether the instant disposition is lawful

A. The Plaintiff’s assertion that the monthly rent of the child-care center of this case was paid as money, not the child-care fee, and thus, the instant disposition was unlawful by abusing and abusing discretion, on the ground that there is no ground for disposition, or that the disadvantages suffered by the Plaintiff were too much higher than the public interest purpose to be achieved.

(c) Where the head of a Si/Gun/Gu finds accounting fraud, illegal act, or other improper act of a social welfare facility under Article 40(1)4 of the Social Welfare Services Act.
