1. According to the Plaintiff’s amendment of the purport of the claim in the trial, the judgment of the first instance is modified as follows.

Reasons
1. Basic facts
A. A. On September 1973, C newly constructed a Boro mentor and 47.27 square meters of a single-story house in Ulsan-gu, Ulsan-gu (hereinafter “D”) owned by itself (hereinafter “D”) on the 175 square meters of land, and each registration of ownership transfer was completed in the name of G on October 6, 1978 with respect to the said D land and housing.
B. Around 1981, the Plaintiff’s attached land leveled 107 square meters (hereinafter “I land”) and 107 square meters (hereinafter “I land”) adjacent to D land, and around 1984, the Plaintiff’s attached land leveled I land and D land leveled to repair the existing I land. After the survey, H installed a fence in the form of a straight line used as the boundary of I and D land, which was used as the B and D land leveled, with a new fence (attached Form 1 indication 1, 2, 3, 10, 18, and 19 connected each point in attached Form 13, 10, 10, 18, and 19, which connected each point in attached Form 3 indication 9, 10, 11, and 12; hereinafter “the instant fence”).
C. After the death of H, the Plaintiff completed the registration of ownership transfer on the land of September 24, 1996 by agreement and division on March 13, 1996. The Defendant purchased D land and buildings from G on October 20, 201, and completed the registration of ownership transfer on November 14, 1996.
원고와 피고 사이에 I 토지와 D 토지의 경계에 대한 다툼이 있자, 피고는 원고를 상대로 2011. 11. 30. 울산지방법원(2011가단39358, 이하 ‘관련사건’이라 한다)에 D 주택과 이 사건 담이 I 토지를 침범한 부분(이하 ‘이 사건 계쟁부분’이라 한다)에 대하여 점유취득시효완성을 원인으로 한 소유권이전등기를 구하는 소를 제기하였는데, 위 소송에서의 감정인 L은 "D 주택과 이 사건 담이 I 토지 중 별지 1 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, 8, 1, ㄱ의 각 점을 차례로 연결한 선내 ㈏부분 20㎡를 침범하였고, 그 중 별지 1 도면 표시 ㅇ, ㅅ, ㅂ, ㅁ, ㅇ을 순차로...
