1. The Defendant’s KRW 45,00,000 as well as the Plaintiff’s KRW 15% per annum from May 26, 2019 to May 31, 2019.

1. From February 26, 2016 to February 1, 2017, the Plaintiff was supplying lighting fixtures, etc. to D Co., Ltd. operated by the Defendant, and the unpaid amount of KRW 44,910,00. However, upon urging the Plaintiff to pay the outstanding amount, the Plaintiff failed to pay the agreed amount by February 23, 2019, even though the Defendant promised to pay KRW 45,000,000 to the Plaintiff by February 23, 2017.

On the ground of partial dismissal of claims, only damages for delay calculated by the rate of 12% per annum from June 1, 2019, following the enforcement of the provisions on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 29768) amended on May 21, 2019.
