Reasons
Punishment of the crime
1. Defendant A
A. From November 5, 2009 to January 31, 201, the Defendant was in charge of the maintenance of the P-3C aircraft radar, etc. ordered by the Navy while working as the head of the special project team at the victims F Co., Ltd. F (hereinafter “victim”) located in Seongbuk-gu, Sungnam-gu, Sungnam-si as the victim company E (hereinafter “victim”) from November 5, 201.
The Defendant was aware that the “data package” (VPS-137(V6) loaded on the P-3C aircraft owned by the damaged company is managed as trade secrets, and the unauthorized reproduction and outflow of the data is prohibited.
Nevertheless, around August 2010, the Defendant copied six copies of the P-3C Aircraft Radice Compact (hereinafter “RPC”) system among the data about the foregoing data package in the office of the special business team of the above victim company, and delivered them to B, the representative director of the above company, at H office located in Seongbuk-gu, Sungnam-gu, Seoul, Seoul, about 20:00 on the same day.
As a result, the defendant acquired the above trade secret from B property benefits equivalent to the market exchange value of the above trade secret, caused the damage company's property damages equivalent to the same amount, and disclosed the trade secret of the damaged company to B.
B. On February 1, 2011, the Defendant violated the Unfair Competition Prevention and Trade Secret Protection Act (Leakage of business secrets, etc.) was employed by I Co., Ltd. (H is in fact merged with I Co., Ltd.) and works in the I Seoul Office located in Seocho-gu Seoul Metropolitan Office by June 21, 2012, and two RPCs maintained by H Co., Ltd. from the Navy headquarters on April 5, 2010 and two RPCs maintained by HP headquarters on July 5, 201, which were maintained and ordered by H Co., Ltd. and two RPCs maintained by the Navy headquarters on July 5, 201.
