1. Basic facts

A. On June 9, 2017, at around 02:15, the Defendant driven a C-car (hereinafter “Defendant vehicle”) with a blood alcohol concentration of 0.109% 0,000, and attempted to stop so as to avoid drinking driving by police officers on the front side while driving the road in front of the D-building in Busan-gu, Busan-gu, the Defendant attempted to stop so as to avoid drinking driving. However, the Defendant, a police officer discovered it, was subject to drinking control by E, and accordingly, was required by the said victim for measuring the blood alcohol concentration.

Accordingly, in order to escape control, the defendant started from the defendant's own vehicle and opened a driving seat frame opened by him, and caused approximately 18 meters to go beyond the road floor, thereby causing the victim to inflict an injury, such as the trosle, the right pansle, the right pansle, etc. on the victim.

Article 3 (Compensation for Loss) The Insurance Company shall compensate for the loss sustained by the insured as a result of the insured's death or injury to another person due to the operation of the insured motor vehicle under Article 3 of the Guarantee of Automobile Accident Compensation Act.

Article 5 (Compensation for Non-Compensation) Loss caused by the intention of the policyholder or the insured shall not be compensated by the Large Compensation I.

Provided, That where a victim has made a direct request to an insurance company under Article 10 of the Guarantee of Automobile Accident Compensation Act, the insurance company shall be limited to the amount prescribed by the Automobile Accident Compensation Act.
