1. The Plaintiff, Defendant C, Defendant C, Defendant B, Defendant B, and Defendant B, respectively, from September 29, 201, to KRW 8,372,504.

1. Evidence 【Evidence】 1-1, 2, A2, A3-1, 2, A4, A6, B-7, B-8, B-9, B-10, and the result of appraiser D’s appraisal and the purport of whole pleadings;

A. (1) The Plaintiff is a part of the owner of the apartment house on the second floor of the wall structure of the Seongbuk-gu Seoul and the wall structure of the building E and the second floor of the building, and was granted by the other co-owners the right to dispose of the above land and the building (hereinafter “Plaintiff’s land and the building”). Defendant B is adjacent to the high zone on the north of the Plaintiff’s land and the building, and Defendant B owns the Seongbuk-gu Seoul Party F land and the unit of the building on the second floor (hereinafter “Defendant’s land and the house”).

(2) The boundary of the Plaintiff’s housing and the Defendant’s housing is a shape in which the first floor of the Defendant’s housing is above the first floor of the Plaintiff’s housing, and the Defendant’s housing is seated above the upper floor of the Plaintiff’s housing.

The height of the stable is about 3.5m to 4m and the water coming from the stable flows from 5 to 6m respectively, and the water flows from the stable to the drainage hole outside the plaintiff's house.

B. On June 7, 2010, in order for the Plaintiff to request and urge repair works to prevent wastewater from being discharged into the Plaintiff’s housing on June 7, 2010, the Defendants’ assaulted the Plaintiff during the process of preventing Defendant C from doing so by Defendant C, who is the mother of Defendant C, and thereby suffered injury to the Plaintiff’s escape certificate of conical signboards No. 4-5-Woman 1.

(2) On April 28, 2011, the Plaintiff, who was not Defendant B, posted the windows of the second floor of Defendant B’s housing at the fishing market on the Plaintiff’s rooftop on April 28, 2011. Accordingly, Defendant B, who led Defendant B to the end of the fishing market, suffered injury to be treated for 14 days, such as the right scarde, etc.

2. The allegations by the parties and the judgment of this court

A. Whether the right to claim remuneration against the defendant B is established (the plaintiff's assertion) is the plaintiff's housing from the defendant's housing to the plaintiff's housing.
