1. The plaintiff's claim is dismissed.

1. Basic facts

A. On August 2012, the Plaintiff received from the Defendant a supply of the following construction works among the new construction works of neighborhood living facilities (hereinafter “instant construction works”) on the ground of Jeju City, from the Defendant at the end of August, 2012, at KRW 134 million (excluding value-added tax). The commencement date of the construction works at the end of August 2012 determined the completion date within 90 days after the commencement date.

B. The scope of the instant construction project is as follows.

1) Details of common provisional construction, earth and sand construction, reinforced concrete construction, waterproof and aesthetic works, stone construction, stone-frame construction, steel-frame and intermediary construction, windows and glass works, incidental engineering works, electrical construction works, electrical construction works, machinery and equipment construction 2) various installation costs, water supply costs, internal joints, external balcony and string works, and household construction, including reclamation, etc. in a restaurant among lighting equipment.

C. The Plaintiff and the Defendant changed the parts of the instant construction, which were larger than the original design, and changed the two pages, including the static face from 1st page, into the entire heading facility, and added the automatic text.

The Defendant agreed with the Plaintiff to directly perform the instant construction among the instant construction works and caused conflicts between the Plaintiff and the Defendant during the process of performing the instant construction works, and the Plaintiff discontinued the instant construction works around October 2012, and until the time, the period of the instant construction works and the proceeds therefrom are as follows.

1) Of the common provisional construction works, regular mold construction and food construction has been completed, and molding and field rearrangement have not been completed, and the ratio of flag is 3.29%, and 2,301,600 won is 2,301,600 won. 2) Land works have been completed, and the rate of flag is 100%, and the price of flag shall be 5,407,000 won.

3. The construction of reinforced concrete scale 25-210-15 ready-mixed is not only the first agreed 138 cubic meters, but also 92.3 cubic meters. The steel bars of size HD10 are not the first agreed 1 ton, but 0.9 tons, 7.2 tons, not the first agreed 8 tons, and 7.2 tons of HD16.
