A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On July 18, 2014, the Defendant: (a) sold 3,372 square meters in the name of “F” in the name of “F” in the name of “F” in the name of “F” in the E judicial scrivener office located in Sju-si; (b) sold 33,66 million square meters in the name of “F” in the name of F; (c) on the day when the contract was concluded, the Defendant made a false payment of KRW 50 million in the down payment; and (d) the intermediate payment of KRW 40 million in July 21, 2014; and (d) the remainder of KRW 246,66 million in the form of “F” in the name of F, thereby making an agreement with the victim for the registration of transfer of ownership; and (e) when the remainder is received, the Defendant would have made a false payment to the victim for the remainder of ownership transfer.
However, in fact, the Defendant received KRW 960,000,000 from I for the development project of the housing site for electric power sources that were in progress, and did not distribute or repay profits even after borrowing KRW 400,000 from J, and as I could not cancel the right to collateral equivalent to KRW 558,000,000 established in the name of K. The Defendant did not have any intent or ability to cancel the said right to collateral even if the Defendant sold the said forest shares to the victim and received the purchase price, and to complete the registration of transfer of ownership.
As above, the Defendant: (a) by deceiving the said victim; (b) received each delivery of KRW 50 million in total, and KRW 90 million in intermediate payment around July 21, 2014, from the victim, around July 18, 2014; and (c) KRW 40 million in total, around July 21, 2014.
“M” located on January 10, 2015, the Defendant sold KRW 610 square meters of Lan Forest, O, P, and Q 73 square meters of land owned by the Defendant to the victim N, and KRW 30 square meters of total purchase price at KRW 250 million of total purchase price at KRW 50,000,000, intermediate payment, KRW 74.2 million, and KRW 125,80,000,000 of total payment, and the remainder payment is paid.
