Reasons
1. In full view of the facts that there is no dispute over the claim for partition of co-owned property, the entries in Gap evidence Nos. 1 and 2, and the purport of the whole pleadings, the plaintiff and the defendants owned 1/4 shares among the land of this case, and the facts that no agreement has been reached between the plaintiff and the defendants as of the closing date of pleadings of this case. Thus, the plaintiff may file a lawsuit against the defendants, other co-owners, in accordance with Article 269(1) of the Civil Act.
