이에 G는 성명 불상의 떴다방 업자로 하여금 2011. 6. 7.경 김해시 H 아파트 분양사무소에서 위 J 외 3명 명의로 위 H 아파트에 대한 장애인 특별분양 신청을 접수하게 하여, 2011. 6. 16.경 J가 위 아파트 202동 1004호에, K이 위 아파트 204동 902호에, L이 위 아파트 204동 703호에, M이 위 아파트 103동 1401호에 각 당첨되자, 위 떴다방 업자로 하여금 2011. 6. 23.경 위 J 등 명의로 위 아파트에 대한 분양계약을 체결하게 하고, 그 무렵 위 J 등이 취득한 위 아파트의 입주자 지위를 N 외 3명에게 전매하도록 하였다.
