The prosecutor's appeal is dismissed.

1. Summary of the grounds for appeal, sentencing and police officer (in the case of original trial, eight months of imprisonment, two years of suspended execution, 40 hours of taking courses, and 80 hours of community service);

2. We agree with the prosecutor's arguments that the defendant's liability for the crime is heavy, such as the case where the judgment was made, the number of crimes is inferior, and there is no suspicion of victims. However, in examining the sentencing conditions under Article 51 of the Criminal Act, including the circumstances determined by the court below, the court below's determination of the punishment is acceptable, and there is no illegality of unfair sentencing.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
