1. Defendant A shall pay 43,034,200 won to the Plaintiff and 20% per annum from April 30, 2014 to the Plaintiff.

From September 2013 to February 24, 2014, the Plaintiff supplied ELD products to Defendant A branch technology corporation, which became aware of as Defendant A’s intermediary. Defendant Company did not pay 43,034,200 won in total for September and October, and Defendant A promised to pay the above goods.

First, since Defendant A fully acknowledges the Plaintiff’s claim, Defendant A is obligated to pay to the Plaintiff 43,034,200 won and 20% interest per annum from April 30, 2014 to the date of full payment.

Next, the defendant company asserted that in September 2013 and October 2013, the defendant company was supplied with ELD products by Defendant A, and that the tax invoice was issued in the name of the plaintiff company twice at the request of the plaintiff company and the payment was made. However, the plaintiff and ELD products were not traded.

According to the witness Gap's testimony, in September and October 2013, A assembled and delivered ELD products supplied by the plaintiff to the defendant company. In the course of delivery from the plaintiff, A borrowed name upon request of the defendant company, the defendant company issued the tax invoice with the plaintiff and paid the price to the above two months upon request by A, and A made a transaction under the above company's name after establishing B around December 2013, and otherwise there is no evidence to acknowledge that there was a supply contract between the plaintiff and the defendant company for ELD products. Thus, the plaintiff's claim against the defendant company is dismissed as without merit.
