[209 Man-Ma26] Defendant A was in the position of K to exercise substantial influence over the operation of the above J University as the third person who established the J University (hereinafter “J University”), which is the founder of the above J University (hereinafter “J University”) around April 25, 2008, and was in the position of exercising the above J University from July 13, 2007 to October 4, 2007, as the vice principal of the above university, from October 5, 2007 to the above university as the principal of the above university, and has overall control over the affairs concerning the overall operation of the above university, such as recruitment of faculty members of the above university, wages, and school expenses.

Defendant

B entered L around October 1989, while serving as the president of M Co., Ltd and N Co., Ltd., and serving as the president of the board of directors of M Co. and N Co., Ltd. from July 1, 2004 to November 30 of the same year, he concurrently served as the secretary general of the above school foundation and the head of the planning office of the above university. After doing so, he served as a director of the above school foundation and the head of the planning office of the above university, and on August 27, 2007, he was appointed as a director of the branch office for attracting students from the above foreign university on August 27, 2007.

C is in the position to exercise substantial influence over the operation of the above J College from January 31, 1996 to February 15, 198, by serving as the president of the Foundation A of the above J College as the third child of K, the founder of the above J College.

K was sentenced to three years of imprisonment with labor for the violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Embezzlement) in the Seoul Central District Court on February 3, 2006, and was in the Seoul High Court on May 2, 2007, the person who escaped from Korea, such as Japan through the Sea Kakkhstan, etc. around May 2, 2007, and the said school juristic person was established
