A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[2018 Highest 1960] The defendant is a brokerage assistant working in the "C" located in Ansan-gu, Masan-si B, and became aware of the victim D while managing the building owned by the victim.

On December 1, 2014, the Defendant contacted the victim D in the above C, and falsely concluded that “If the lessee of another person’s building has a director, if the lessee of another person’s building is to have a director, he first pays the deposit to the lessee, and if the new lessee is absent from director, he/she would immediately pay the deposit money and pay 70,000 won per month.”

However, in fact, the Defendant had been urged to repay the obligation owed by her husband who was dead at the time and had been forced to repay the obligation by 88,00,000 won by her husband, and there was no special property and there was no intention or ability to repay the obligation by her husband even if she borrowed money from her husband because she had been first used to repay the obligation by her husband.

Nevertheless, around December 1, 2014, the Defendant received KRW 11 million from the victim to the E account under the name of the Defendant, and received KRW 5 million in cash on the same day. From around that time to October 21, 2016, the Defendant received KRW 89 million in total over 10 times, such as the list of crimes, from around that time to October 21, 2016.

After all, the defendant was given property by deceiving the victim.

[2019 order68] The Defendant is a broker assistant of the licensed real estate agent office, and the Defendant is obliged to return KRW 66,50,000,000,000,000,000 from the victim H, who is the lessor of Ansan-si, Busan-si, and the lessor of G (hereinafter “Gho”) to become the tenant, and the tenant I would be the tenant of the previous lease deposit amount of KRW 70,000,000,000,000,000,000 won.

It shall be returned to the Korea Land and Housing Corporation by adding up the deposit money and the money paid by the victim by finding a new tenant of the above G.
