Reasons
Punishment of the crime
[Criminal Power] Defendant A was sentenced to three months of imprisonment for fraud at the Gwangju District Court on October 12, 2012 and confirmed on December 10, 2012.
【Criminal Facts】
1. On June 1, 201, Defendant B received KRW 10 million from the victim’s bank account (G) in the name of the Defendant, on the following grounds: “Around June 1, 2011, the Defendant, in the E cafeteria located in Gwangju-gu, has been using only one week if he/she has carried out several overseas projects of the current KIKOs and the Malaysia has borrowed money for the business expenses.”
However, the defendant did not have any overseas business that was promoted at the time of KIKO or Malaysia, and even if he received the money from the victim, he did not have any intention or ability to pay it.
Accordingly, the Defendant received a delivery of KRW 10 million by deceiving the victim.
2. On August 30, 201, Defendant B, at the I hotel coffee shop located in Gwangju-gu, Nam-gu, Gwangju-gu, provided that, “The Defendants met with the scale of J during the domestic construction and there is a reliable construction work.” The Defendants met with the victims at the Gwangju International hotel coffee shop. Defendant A, while indicating the construction drawings, displayed the victim’s plan to “I wish to start the construction work of L Urban Residential Housing on five lots outside Gwangju-gu, Gwangju-gu, and then I want to start the construction work, and to loan KRW 30,000,000 as necessary for this construction work’s electrical, telecommunication, and fire fighting construction work’s subcontracting, and regardless of being awarded a contract for the construction work, this money was borrowed until October 5, 201, and the said money was transferred from the victim’s account on August 3, 2013.
However, the Defendants did not have the ability to subcontract electrical construction among L-type Urban Housing Construction Works to others, and the said money from the victims.
