A defendant shall be punished by imprisonment for one year.

Punishment of the crime

[Criminal Power] On February 7, 2012, the Defendant was sentenced to imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (a collective action, deadly weapons, etc.) at the Daejeon District Court on February 7, 2012, and completed the execution of the sentence in the Daejeon Prison on June 10, 2013.

1. On October 23, 2013, the Defendant: (a) around 23:00, at the “EM store” operated by the victim D in Jung-gu Incheon, Jung-gu, Incheon; (b) on October 12, 2013, the Defendant ordered an alcoholic beverage and an alcoholic beverage as if he would normally pay the price despite the absence of the intent or ability to pay the price, and (c) was provided by the victim with alcoholic beverage and an alcoholic beverage equivalent to KRW 226,00,00, such as an alcoholic beverage and an alcoholic beverage 10,000, from the victim.

Accordingly, the defendant was given property by deceiving the victim.

2. Violence;

A. On October 13, 2013, at around 02:00 on October 13, 2013, the Defendant assaulted the victim F (year 44) who was an employee of the Defendant, who did not pay the drinking value, demanding the payment of the drinking value, and met the Defendant’s co-ordin, by breaking the victim’s head bonds over the floor, and breaking the victim’s head bonds into the floor and leaving the face on the hand.

B. On October 13, 2013, at around 02:35, the Defendant assaulted the victim D(50 years of age) to return the said F’s mobile phone brought by the Defendant, and resisting the said F’s mobile phone from Jung-gu Incheon, Jung-gu, Incheon, by twice in his/her hand.

3. A thief: (a) around 02:05 on October 13, 2013, the Defendant abused the victim F from “E stores” as referred to in paragraph (1) to paragraph (2) as referred to in paragraph (a) of Article 2; and (b) stolen the victim’s cell phone at the market price equivalent to KRW 500,000, which was owned by the victim who was in a crepanion.

On October 20, 2013, the Defendant: (a) around 23:25 on October 20, 2013, at K stores operated by the Victim JJ on the I underground floor of Jung-gu Incheon, Jung-gu, Incheon, the Defendant would normally pay the price even if he/she is provided with alcoholic beverages, regardless of his/her intention or ability to pay the price.
