Defendants shall be punished by imprisonment for one year and six months.

However, with respect to Defendant B, the period of three years from the date this judgment became final and conclusive.

Punishment of the crime

[Criminal Records] Defendant A was sentenced to eight months of imprisonment with prison labor for a violation of the Narcotics Control Act at the Jung-gu District Court on October 12, 2015 and completed the execution of the sentence at the Jung-gu District Court’s prison on March 13, 2016.

[Criminal facts] The Defendants are not narcotics handlers, and they shall not handle mert clopules (one philophones, hereinafter “philophones”), marijuana, or hemp seed coatss.

"2018 Gohap 37" (Defendant A)

1. Violation of the Narcotics Control Act;

A. On April 2, 2016, at around 05:00, the Defendant issued a penphone to H in a manner of drying a day-to-day injection device containing approximately 0.1g of philopon, within a passenger car stopped on the front of G Jeongcheon-si, Chuncheon.

B. On April 8, 2016, around 22:00, the Defendant received two philophones by taking two philophones using a single philophone in the Songpa-gu Seoul Metropolitan Government Officetel containing approximately 0.8g phiphones from H.

On April 10, 2016, the Defendant received two philophones by receiving two philophones from H in the instant “I” officetels and approximately 0.8g philophones.

On April 12, 2016, the Defendant: (a) laid off an officetel “I”; (b) laid down a disposable injection device containing approximately 0.8g of phiphones from H; and (c) laid down the philophones into J and each part-time injection device; and (d) received and administered philophones by means of inserting approximately 0.1g of philophones into the body, being melted into the body.

E. From April 12, 2016 to around the 14th day of the same month, the Defendant administered phiphones by inserting approximately 0.1g of philopon in the instant “I” officetel, and melting it into water, and in injection into the arms.

F. On November 7, 2017, the Defendant administered philophones by inserting approximately 0.1g philophones in a single-use injection machine, melting them into water, and in injection into the arms, around November 7, 2017.
