A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 11, 2014, the Defendant was sentenced to one year to imprisonment for fraud, etc. at the Busan District Court on April 11, 2014, and the said judgment became final and conclusive on the 19th day of the same month.

1. The Defendant: (a) delivered a passbook, etc. from a person who was unaware of his name with the intention of opening an account in C’s name in order to obtain a loan; and (b) received the loan.

On September 21, 2012, the Defendant forged private documents: (a) around September 21, 2012, in the name column of the application form for opening a bank account at the head office of the Busan Bank located in Bupyeong-gu Busan, Busan, the Defendant prepared “C”, “D” in the resident registration number column, and “C” in the applicant column and signed the “C” in the applicant column.

Accordingly, for the purpose of exercising, the Defendant forged a copy of the application for joining the Busan Bank in the name of C, which is a private document on rights and obligations.

B. The Defendant at the above date, time, and place, submitted to the above Busan Bank employees who knew that the above application for subscription was forged, and exercised the above investigation document as if it were a document duly formed.

On March 14, 2013, the Defendant forged private documents at a new bank office located in the Jung-gu Office of Busan, Jung-gu, Busan, the Defendant signed the name column “C”, “D”, “F”, “F”, and “C” in the mobile phone column and signed the name “C” next to the Defendant’s application form for opening a new bank account in the form of the application form for opening a new bank account located in Jung-gu, Busan., the Defendant signed the name “C”, “D”, “B”, and “C” on the mobile phone column.

For the purpose of uttering as above, the Defendant forged an application form for opening a new bank account in the name of C, which is a private document on rights and obligations.

B. The Defendant at the above date, time, and at the above place, was the genuine establishment of the application form for the subscription to the new bank account, and thus, the said new bank may be deemed to have been aware of it.
