A defendant shall be punished by imprisonment for not less than eight months.

Reasons
Punishment of the crime
The Defendant knew the fact that in the Seongbuk-gu Seoul Metropolitan Government “E Hospital”, the Health Insurance Corporation issued a false certificate of hospitalization as if the patients were hospitalized even though the patients did not receive the hospitalized treatment, thereby allowing the patients to receive false insurance money, and used this to obtain insurance money from the insurance company.
around 2010, the Defendant subscribed to the Victim Hyundai Marine Fire Insurance Co., Ltd., and submitted a written confirmation of hospitalization as if he was hospitalized for 19 days from September 17, 2010 to October 5, 2010 on the ground that the insurance proceeds were rapidly lowered from mountain on June 9, 2010. The Defendant requested the said Victim Co., Ltd. to pay insurance proceeds to the said Victim Co., Ltd. on August 9, 2010, and submitted a written confirmation of hospitalization for 27 days from July 5, 2010 to July 31, 2010.
However, in fact, since the defendant obtained a false certificate of hospitalization at the E Hospital for the above reasons and obtained it, he did not get out of the hospital from time to time during the period of hospitalization and did not receive normal treatment.
Nevertheless, the Defendant, by deceiving the above victim company and claiming insurance money, received insurance money equivalent to KRW 4,159,120 from the above victim company from August 10, 2010 to December 24, 2010.
In addition, from August 3, 2010 to July 21, 2011, the Defendant acquired KRW 56,364,883 from 12 insurance companies in total for 30 times from 12 victims as shown in the annexed crime list by submitting a false written confirmation of hospitalization issued by E Hospital while claiming insurance proceeds as above.
