1. The Defendant (Counterclaim Plaintiff) against the Plaintiff (Counterclaim Defendant)

Reasons

1. 사실관계 [인정근거] 다툼 없는 사실, 갑 1∽3, 12호증의 각 기재, 변론 전체의 취지 원고는 2016. 7. 2. 피고와 사이에 ① 별지 목록 제1항 기재 부동산(이하 ‘이 사건 상가’)에 관하여 임대차기간 2016. 9. 1.부터 2021. 8. 31.까지, 임대차보증금 2,000만 원(1년 후 지불), 월 차임 150만 원(매월 30일 선불), 용도 일반음식점, 편의점으로 한, ② 별지 목록 제2항 기재 부동산(이하 ‘이 사건 주택’)에 관하여 임대차기간 2016. 9. 1.부터 2018. 8. 31.까지(다만 이 사건 상가의 임대차 종기 2021. 8. 31.까지 갱신키로 한 것으로 보임), 임대차보증금 1,000만 원(1년 후 지불), 월 차임 40만 원(매월 30일 선불)으로 하는 각 임대차계약(이하 통틀어 ‘이 사건 임대차계약’)을 체결하였다.

A. The Plaintiff’s assertion: (a) the Defendant delayed the rent of KRW 4.5 million for the instant commercial building on February 2, 2017 through April 4, 2017 (=1.5 million won per month x 3 months); (b) the rent of KRW 1.2 million per month (=4 million per month x 3 months); and (c) the Defendant did not pay each lease deposit.

Accordingly, the Plaintiff terminated the instant lease agreement as a delivery of a copy of the instant complaint on the grounds of the foregoing delay, and as a preparatory document on the grounds of the non-payment of each lease deposit, the Plaintiff terminated the lease agreement as a preparatory document on January 8, 2018.

Therefore, the defendant delivers the commercial building and housing of this case to the plaintiff.
