A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On August 10, 2012, the Defendant violated the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. (sexual traffic) (hereinafter “E”), around 03:30 on August 10, 2012, paid to the entertainment tavern “E” operated by D located in Gangseo-gu Seoul Metropolitan Government, with the entertainment entertainment drinking fee, KRW 200,00 as a customer, and paid to D with the entertainment entertainment drinking fee as follows: around 05:30 on the same day, the Defendant carried out the act of buying sex by entering the “Gel” room 209, which is adjacent to the said alcohol house, with the F and the single sexual intercourse.

2. The Defendant, at around 05:30 of the above day, did not conduct circumstances in light of the victim F (37 years of age, female) and one-time sexual intercourse in the above room 209.

Accordingly, the defendant caused the victim to feel out of the situation, and requested the victim to feel up with the victim's sexual organ for about one hour.

However, the victim who did not have the Defendant's sexual organ yet tried to make his cell phone calls in order to return to the house and bring a taxi in mind.

그러자 피고인은 위 휴대전화기를 빼앗아 내던지면서 “내가 화곡동 양아치다, 한 번 돌면 뵈는 것이 없다.”고 하였으나 그래도 피해자가 옷을 챙겨 입으며 나가려 하자 “네가 아직 임자를 못 만났구나. 네가 오늘 독종을 만난 줄 알아라.”고 하면서 양 손바닥으로 피해자의 얼굴을 약 10분간 때린 다음 피해자를 끌어당겨 침대에 눕히고 다시 손바닥으로 피해자의 얼굴을 때리고 양손으로 목을 졸라서 피해자의 반항을 억압한 다음 피해자에게 구강성교 등 변태성행위를 강요하다가 이윽고 발기가 되자 피해자의 성기에 피고인의 성기를 삽입함으로써 피해자를 강간하고, 위와 같은 폭행으로 인하여 피해자에게 약 3주간의 치료를 요하는 뇌진탕 등 상해를 가하였다.
