A defendant shall be punished by imprisonment for four years.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

The defendant is a driver of D-si, and the victim E (V, 39 years old) is a person with mental disability who has intellectual ability 48 and social index 51 (age 7 and 2 months).

1. From around 2015, the Defendant had become aware of the victim’s mental disorder while communicating with the victim who used the said taxi from time to time. On August 23, 2017, the Defendant had been willing to have sexual intercourse by using the fact that the victim did not have any way in his/her own house.

On August 23, 2017, the Defendant called the victim at around 17:10, saying, “I ambling sofab, I ambling at home, so I would like to drink.” On the other hand, I am the victim at the victim’s house located in the F of the Newanan-gun, Newan Military F, and then I am the victim at the victim’s house located in the said taxi and went to the victim’s house located in G.

Accordingly, the defendant inducedd the victim for the purpose of sexual intercourse.

2. On August 23, 2017, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (e.g., deceptive schemes, etc. against the disabled) has completed meals with the victim at his/her home as described in paragraph (1) of around 17:20 on August 23, 2017, and then “huming

” 는 취지로 말하고, 이에 피해자가 몸을 씻기 위해 옷을 벗고 욕실 안으로 들어가자, 피해자를 따라 욕실 안으로 들어가 피해자의 몸을 씻어 준다는 이유로 손으로 피해자의 가슴과 음부 등을 만지고 입으로 피해자의 가슴 부위를 빨고, 계속하여 피해자와 함께 거실로 나와 알몸 상태인 피해자를 강제로 거실 바닥에 눕힌 후 피해자가 손으로 피고인의 몸을 밀고 버둥거리면서 저항하였음에도 입으로 피해자의 가슴을 빨고 혀로 피해자의 음부를 핥으면서 피해 자의 위에 올라 타 성기를 피해자의 음부에 삽입하려고 하였으나 성기가 발기가 되지 아니하여 그 뜻을 이루지 못하였다.
