A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

Around May 2007, the Defendant heard that there was a way to receive a loan of the entire loan from a lending business entity whose name the name of contact was reported on the loan advertisement inserted in the rice Luxembourg market was unknown, by drawing up a false lease contract with the Defendant as a lessee. Around that time, C also made a false lease contract using Da and 402 (E) which is a woman’s ownership, and made a false lease contract and made it divided with the said lending business entity.

Around May 2007, the Defendant entered into a false real estate lease agreement, stating that “A, lessee A, a deposit amount of KRW 38 million, and May 26, 2007,” in relation to the above house, even though the Defendant did not actually leased the above house owned by C, lessee A, and the date of the contract.”

On May 30, 2007, the Defendant submitted a lease contract that was made by the employee in charge of loans at the high-dong branch of the victim Korean bank located in Guro-gu Seoul, Guro-gu, Seoul, and applied for a loan of KRW 26 million to the employee in charge of loans.

As above, the Defendant deceivings the above bank employees, and then, he was transferred KRW 26 million to the Agricultural Cooperatives Deposit Account in the name of C on June 8, 2007 from the affected bank.

Accordingly, the Defendant received property by deceiving the damaged bank in collusion with the lender who is not known with C or name.
