1. Basic facts

A. The Defendant is the council of occupants’ representatives composed of representatives from Seongbuk-gu Seoul Metropolitan Government B apartment (hereinafter “instant apartment”), and the Plaintiff was elected as the representative of the instant apartment Cdong around June 1, 2017, and was elected as the chairman of the council of occupants’ representatives.

B. Ten residents of the instant apartment complex, including D, E, and F, filed various suspicions against the Plaintiff, and began to be subject to the Plaintiff’s signature from April 4, 2018. On April 26, 2018, the Plaintiff signed 357 occupants of the instant apartment complex, etc., and requested the Defendant’s Election Commission (hereinafter “Election Commission”) to proceed with the procedure of dismissal of the Plaintiff.

The reasons for removal stated in the request for dismissal of April 26, 2018 are as follows:

C. On May 15, 2018, the Election Commission decided to proceed with the procedure for the dismissal of the Plaintiff, and on May 24, 2018, passed the dismissal voting (hereinafter “instant dismissal voting”), and 170 of the total number of 684 members, including occupants, shall be approved.
