1. The plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Details of the disposition;
A. The Plaintiffs: (a) around 2016, the land B, C, D, and other four parcels in Gwangju-si, Gyeonggi-do;
E. It is a sound part among the attached Form 1 drawings.
The "Plaintiffs' land" is referred to as "land," and the relevant land in this case is specified as the parcel number, land category, and land pointed out.
B. Of the Plaintiffs’ land, G forest land owned by F is not less than 306 square meters of G forest land owned by F (hereinafter “instant forest land”).
A) On February 5, 2016, the Defendant designated and publicly announced the said forest as a road. (c) On June 18, 2017, the Plaintiffs filed an application for permission to construct a new building on the Plaintiffs’ land with at least three floors and less than ten floors. However, on July 17, 2017, the Defendant filed an application for permission to construct a new building on the Plaintiffs’ land, but the Defendant filed an application for permission on the ground that the road to enter into and depart from the relevant site does not fall under the existing road (referring to a road, the completion inspection of which has been completed or the commencement of use has been completed) under attached Table 4 of the Enforcement Decree of the Management of Mountainous Districts Act, and notified the Plaintiffs of the alternative plan to be reviewed at the time of filing an application for re-application. (d) On August 7, 2017, the Plaintiffs filed an application with the Defendant for permission to construct at least four detached houses and four parking lots on the Plaintiffs’ land.
E) On September 19, 2017, the Defendant notified the Plaintiffs of the rejection of permission for development activities (hereinafter “instant disposition”) on the following grounds (hereinafter “instant disposition”).
A. Before 200:
A return ground - The relevant applicant does not adjoin the road, part of G planned to pack and open the road was not included in the permitted site, and it is not possible to pack and open the road as forest land for which the relevant authorization, such as Article 56 of the National Land Planning and Utilization Act and Article 14 of the Management of Mountainous Districts Act, is not obtained, and it is impossible to return this application.
