1. The defendant acceptance intervenor and the plaintiff Gap 9,679,925 won, the plaintiff Eul 9,061,159 won, and the plaintiff C 9,061,159 won and the above.
Reasons
1. The following facts may be found either in dispute between the parties or in full view of the statements in Gap evidence 1-1, 2, and 3-1 to 4, Eul evidence 8-1, 2, and 3, and the whole purport of the pleadings:
The defendant is a company operating passenger transportation services, etc., and the plaintiffs are the defendant's workers, and the plaintiff A, B, and C (Attached Nos. 109, 110, 111, 11, listed in the plaintiff's list) are members of the National Transport Industry Trade Union (hereinafter referred to as the "Trade Union").
B. The wages paid to the Plaintiffs were determined in accordance with the collective agreement concluded between the Defendant and the labor union (hereinafter “instant collective agreement”), the wage agreement applicable to bus drivers, and the separate agreement applicable to cleaning workers. The main contents of the separate agreement concluded on February 12, 2010 are as follows: (a) collective agreement in 2009, 2010, and 2008, 2009, 2010, 2010, and the wage agreement in 2011, and the separate agreement concluded on October 12, 2010 and October 12, 2010.
The term of validity of a collective agreement in the year 2009 is from June 1, 2009 to September 30, 2010; and the term of validity of a collective agreement in the year 2010 from October 1, 2010 to September 30, 2012.
1) Work hours ① Work hours per day shall be 8 hours per day (including hours per hour during the extended period of 7 hours). ② Work hours may be extended, night, and holiday work in accordance with the Labor Standards Act, taking into account the characteristics of transportation business in accordance with the Labor Standards Act; provided, however, that a union does not cause interference with the overall operation in relation to extension, night, and holiday work; ii) payment method and standard payment method of bonus between not less than six months, but not less than three years, but not less than five years, and not less than 3 years, and not less than 5 years, 300%, 450%, 50%, and 60%, 1 bonus shall be paid as follows based on the basic salary of salary class
(2) Bonuses shall be paid in four quarterly installments only to persons who work on the date of payment.
The effective term of the wage agreement of the year 2008 shall be the same as that of the wage agreement.
