A defendant shall be punished by imprisonment for not less than one year and six months.

1.20,000 won shall be additionally collected from the defendant.

The additional collection charge shall be equivalent to the above additional collection charge.

Punishment of the crime

[Power of repeated crime] On March 25, 2015, the Defendant was sentenced to imprisonment with labor for a violation of the Narcotics Control Act at the Incheon District Court on May 11, 2016, and completed the execution of the said sentence at the Gwangju Prison.

[Criminal facts]

1. On November 1, 2016, the Defendant received a single-use injection device from G free of charge, containing approximately 0.5g of merpters (one philopon; hereinafter “philopon”) in front of the Fam in Nam-gu Incheon Metropolitan City E.

2. On December 23, 2016, the Defendant: (a) saw a single-use injection device containing approximately 0.06goponon from the south-gu Incheon Metropolitan City H in front of H around December 23, 2016 to I; and (b) 200,000 won from I.

3. The Defendant: (a) around January 2, 2017, at the vicinity of the Nam-gu Incheon Metropolitan City J, her for a single-use injection with approximately 0.06g of philopon to I free of charge.

4. The Defendant: (a) around January 12, 2017, parked in the vicinity of the Nam-gu Incheon Metropolitan City L, and Ma free of charge a disposable injection device containing approximately 0.03 grams of philopon to M.

5. The Defendant, around January 1, 2017, parked near theO located in the Southern-gu Incheon Metropolitan Area N, with a single-use injection device containing approximately 0.03g of phiphones, free of charge, around the lower court’s lower court.

6. On February 23, 2017, the Defendant: (a) opened approximately KRW 5.48g of philopon from G from the R rests located in Q in Q in Chungcheongnam-gun, Chungcheongnamcheon-gun; and (b) remitted KRW 1 million from the Postal Account in the name of the Defendant to the new bank account in the name of G from the Postal Account in the name of the Defendant.

7. On February 23, 2017, the Defendant: (a) at the entrance of S apartment at the Gangwon-si, put approximately one gram of philopon into a one-time folding machine; (b) T received 500,000 won from U for a single-use injection machine containing the said philopon; and (c) again, the Defendant wn up the said amount to the Defendant.

8. On February 23, 2017, the Defendant is located in the Defendant’s residence located in Bupyeong-gu Incheon, Bupyeong-gu, Incheon around 10:00.
