A Imprisonment with prison labor of two years and six months, and Defendant B shall be punished by imprisonment with prison labor of six months.
However, from the final date of this judgment.
Reasons
Punishment of the crime
1. Defendant A served from June 11, 1999 to February 24, 2010 as operational support and technical personnel of the Ministry of Unification (class VIII) and was in charge of collecting revenues, such as payment of health insurance premiums, value-added taxes, and other ordinary income.
On February 2, 2007, the Defendant: (a) deposited the health insurance premiums of the public officials of the Ministry of Unification, the South and North Korean access offices, one source, value-added tax, interest income, etc. of the unification officials belonging to the Ministry of Unification in the government general office building in Jongno-gu Seoul, Jongno-gu, and other ordinary transfer income in the name of the Ministry of Unification; and (b) has been kept in business for the Ministry of Unification for the Ministry of Unification. (c) around February 2, 2007, the Defendant embezzled the amount of KRW 1.5 million from the Nonghyup Bank on the first floor of the government general office building in the form of the Ministry of Unification and used it for personal purposes, such as credit card payments, from around that time to March 5, 2010, by voluntarily consuming KRW 293,482,975 in the same way as the attached list of crimes (1).
2. Defendant B, from February 25, 2010 to February 13, 2012, performed duties as operational support of the Ministry of Unification and as public officials in technical service (class 9), and was in charge of collecting revenues, such as payment of health insurance premiums, value-added taxes, and other ordinary revenues.
The Defendant, around April 14, 2010, deposited the health insurance premiums of the public officials of the Ministry of Unification, the South and North Korean access offices, one won, value-added tax, interest income, etc. of the unification officials belonging to the Ministry of Unification in the government general office building in Jongno-gu Seoul, Jongno-gu, and other ordinary transfer income, etc. in the name of the Ministry of Unification and kept in business for the Ministry of Unification. On April 14, 2010, the Defendant withdrawn KRW 5,150,410 from the Nonghyup Bank on the first floor of the government general office building in Jongno-gu, and paid KRW 1,009,910 among them as health insurance premiums, and paid KRW 4,140,50,500.
