A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

In order to make the victims withdraw money from the account of the victims by misrepresenting them to an investigation agency, etc. by calls to unspecified victims in the Republic of Korea, the name-free persons operate a host organization of the law that receives money from the victims.

On September 2018, the Defendant, upon receiving the proposal from the employees of the said Bosing Steering Officer, who participated in the said Bosing Organization and agreed to receive cash directly from the victims, to receive KRW 200,000 won per case and KRW 100,000 per day from the victims, he would receive money from an unspecified victim, along with the employees of the said Bosing staff.

On September 14, 2018, at around 09:36, 2018, the above Bosing employees called the victim C, and misrepresenting the police officer and the staff of the Financial Supervisory Service, “I want to withdraw the money deposited in the Party’s account at the Bosing Organization. The withdrawn cash will be delivered to the sender in cash, so it is impossible for us to use it. The letter of confirmation will be given to that person.

“Along with the intent to make a false statement, Defendant 1 prepared a false statement to the effect that he/she was an employee of the Financial Supervisory Service by preparing the certificate of a public official and a certificate of the Financial Supervisory Service, etc. on the front road located in Jin-si, Jin-si, Jin-si on the same day and received KRW 10 million deposited from the F bank account in the victim’s name at around 10:20 on the same day, but Defendant 2 failed to commit an attempted crime from the police officers belonging to the F bank station of Jin-nam, Jin-gu, who had been dispatched by the report of the F Bank employees suspected of drinking, to arrest him/her as a current criminal, at around 10:20 on the same day.

Accordingly, the Defendant conspiredd with the employees of Boishing and attempted to receive property by deceiving the victim.
